Can OER be created with the help of AI?

Creating OER (e.g. texts, images) with the help of AI is an interesting option. However, you should bear in mind that the rules of academic honesty and good scientific practice also apply to AI-generated content.

The existing guidelines and specifications of the respective universities on AI must be consulted at an early stage and naturally taken into account. In any case, it is important to remember that humans are ultimately responsible for the content created with the help of AI. In line with scientific practice, it must be stated what was created using AI.

What legal provisions apply to OER created with the help of AI?

Caution is required if third-party works or parts thereof are included in the output of the AI, as this may constitute a copyright infringement. However, many aspects of AI and the law are not yet regulated. For example, there is still no generally applicable ruling on whether the use of protected material as training data for AI constitutes an infringement.
The German OER community makes the following recommendations: Purely AI-generated materials are copyright-free and can be placed under a CC0 license.
If AI-generated materials are edited by humans, copyright protection may arise. This should then be indicated via an appropriate license, preferably a CC-BY license. In any case, it should be stated that AI-generated content has been used.
